Elon Musk Loses Major Court Battle in OpenAI Lawsuit Against Sam Altman

Elon Musk has faced a significant legal blow in his case against OpenAI and its founder Sam Altman.
The 54-year-old tech entrepreneur had filed suit against the artificial intelligence company, alleging it had strayed from its founding purpose of advancing technology for humanity's benefit. A unanimous jury verdict determined that Musk's legal action came too late, with the claims exceeding California's three-year statute of limitations window.
Throughout the dispute, both sides have leveled accusations that the other prioritized financial gain over responsible AI development. Musk had originally sought $150 billion in damages and called for Altman's removal from the company's leadership. He characterized OpenAI's actions as "stealing a charity," referencing the organization's nonprofit origins.
Despite the courtroom loss, Musk indicated he won't accept the outcome quietly. He announced plans to take the case to the Ninth Circuit Court of Appeals, arguing that the ruling turned on procedural timing rather than addressing the substantive claims themselves.
In a message posted to X, Musk stated: "There is no question to anyone following the case in detail that Altman & Brockman did in fact enrich themselves by stealing a charity. The only question is WHEN they did it! I will be filing an appeal with the Ninth Circuit, because creating a precedent to loot charities is incredibly destructive to charitable giving in America. OpenAI was founded to benefit all of humanity."
