Harvey Weinstein Will Not Face Retrial in Jessica Mann Rape Case

Harvey Weinstein will not face another trial on the rape charge brought by Jessica Mann, prosecutors announced this week.

The Manhattan District Attorney's office confirmed it will not pursue a retrial of the 74-year-old film producer following a mistrial in May. The decision came after discussions with Mann, who expressed her unwillingness to testify again in court.

"To be clear, we believe Ms. Mann's account and her credibility as a witness. This has been an extraordinarily taxing ordeal for her, and she has never wavered while testifying in front of two grand juries and three trial juries over the course of eight years. We thank her for her honesty and her tremendous bravery," Manhattan D.A. Alvin Bragg said in a statement.

With the charge resolved, prosecutors are now advancing sentencing recommendations. They are asking for 20 years in prison for Weinstein's criminal sexual act conviction involving former Project Runway assistant Miriam Haley, which they say reflects "the significant harms his actions have caused Ms. Haley."

The case has spanned years of legal turmoil for Weinstein. He was initially convicted of raping Mann and sexually assaulting Haley in 2020, but that conviction was overturned in 2024 when New York's Court of Appeals ruled the trial judge improperly allowed testimony from women uninvolved in the allegations.

Prosecutors sought a retrial in 2025, during which Weinstein was convicted of criminal sexual act against Haley and acquitted on a similar charge involving model Kaja Sokola. However, the jury could not reach a verdict on the Mann charge, resulting in a mistrial. A subsequent trial this spring also ended in mistrial on the same count.

Weinstein remains incarcerated and is currently serving a separate 16-year sentence from his 2022 conviction in Los Angeles.
